Toros de Osborne[edit]
The Toro de Osborne (Osborne's bull is the logo of a Spanish brandy). It has been widely represented on flags, but it still retains copyright.

- Commons:Deletion requests/Image:BanderaToro.svg cita una noticia sobre una sentencia, pero ya entonces omite un párrafo importante: "Fuentes de la defensa jurídica de Osborne dijeron que ya han presentado el correspondiente recurso ante la Audiencia de Sevilla, a la que aportarán una condena a seis meses de cárcel dictada por la Audiencia de Málaga en 2003 ante otro hecho idéntico.".[1] Efectivamente esa sentencia fue después anulada [2]. --Javier ME (talk) 09:24, 2 April 2011 (UTC)
- Osborne's bull is still a trade mark image. It's not a felony to use it in products that are clearly different to those made and sold by Osborne, but it would be illegal to use it where it could mislead customers, so it is not a completely free image. Please note that the problem is just with files that use Osborne's trade mark image, like the current versions linked by Rastrojo. Images of flags with different black bull silhouettes like [4] or [5] are undoubtedly free. --Javier ME (talk) 09:34, 2 April 2011 (UTC)
- Delete There is no explicit permit that allows using the image. The reason the design was allowed until now, the sentence from Seville, was later overturned. So there is no rationale to keep the image in Commons. --ecelan (talk) 14:50, 2 April 2011 (UTC)
- The rationale to keep the image, derived from the sentence in Seville, was: "the image is PD, as it has become part of the cultural heritage of Spain". The moment the sentence doesn't hold, we are left with a derivative work of art, whose author/copyright holder has not given permission for its free use. --ecelan (talk) 13:36, 7 April 2011 (UTC)
- Comment Trademark protection does not make something "non-free"... see Commons:Non-copyright restrictions. We are strictly concerned with copyright when it comes to deletion, unless an image here is inherently a trademark violation or something (i.e. there is no use which is not a trademark violation). - Keep precisamente la documentación, enlazada arriba, dice en la conclusión:
Los hechos enjuiciados por la SAP comentada no son constitutivos de delito alguno. No hay delito contra la propiedad intelectual porque según la el art. 35. 2 de la LPI “Las obras situadas permanentemente en (…) otras vías públicas pueden ser reproducidas, distribuidas y comunicadas libremente (…)” y este artículo es de aplicación a la silueta del toro de Osborne ya que está situado permanentemente en las carreteras.
El denominado toro de Osborne, 11InDret 3/2006 M. Teresa Castiñeira - Entiendo que le corresponde el régimen de protección de las marcas del registro de patentes pero no de los derechos morales ni económicos del régimen de propiedad intelectual. Lo que la sentencia anulada invoca es la utilización indebida de una marca del registro (marca registrada) pero la propiedad intelectual se refiere a la materialización del acto que en estos casos están construidos por autores de wikimedia. La infracción se produciría si se subiesen materiales gráficos hechos por Osborne, SA. Solo es infracción de marca registrada en los usos más flagrantes, pero igual sería con utilizar maliciosamente las letras de "Coca Cola", el texto de InDret se refiere a que su uso trasciende el de identificar las bebidas de la marca Osborne.
- English: Keep as, per the documention above, it's not "infraccción de la propiedad intelectual" ("copyright violation" in continental law) but a case of a trademarked logo which has a exceptional regime due to being considered a public symbol that went beyond the mark. Also Spanish State Freedom on Panorama law.
